American asked Shenzhen company for compensation
American Andrew Blake Aker filed an appeal in the Futian court asking a Shenzhen company to compensate him for using his picture without his permission.
Shenzhen Breo was ordered to stop using Aker’s photo in its ads that promotes a head massage device, and to publicly apologize to Aker. Aker said an modeling agency approached him and persuaded him to use the helmet to use it as a reference photo in case they can find him work in the agency in the future, but the company never called or paid him for the photo. Aker demanded for 100,000 yuan as compensation plus another 50,000 yuan for psychological harm.
During a hearing Aker accused Shenzhen Breo of continuing to use his photograph even if the Futian court have already rendered a verdict, but still have to hand down a decision.
