Drafted rules seeks public opinion
A draft of the Shenzhen Special Economic Zone Collective Negotiation Rules was released to solicit opinions from the public. According to the new rules employers are obligated to negotiate with trade unions that represent their employees at least one a year.
Management and employer will meet to discuss on their workers working conditions, wage scales, working hours, training, health and safety, grievance and rights to participate in workplace or any company affairs.
This would change the situation where in the employer is the only one who decides on how to give the wages and benefits of its employees. The new rule will focus on wage negotiations since many issues are salary related, plus training is also a concern in the new rules. Most workers today needs to learn more skills to improve themselves. If the two sides will not be able to reach an agreement after negotiations they can turn to labor authorities for arbitration.
And if any sides refuses collective negotiation they can be warned by the labor authorities and fined between 10,000 to 50,000 yuan if they continue to refuse negotiations.
