Foreign Companies Required to Employ Chinese Workers
Foreign Companies represented by organizations in Shenzhen will be required to employ Chinese workers through government assigned employment agencies. The requirement also applies to companies from Hong Kong, Macao and Taiwan.
There are only three employment agencies currently authorized by the Guangdong Provincial Government in Shenzhen. The companies are Shenzhen Foreign Service Co. Ltd., Shenzhen Zhonghe Foreign Enterprises Service Co. Ltd., and China International Intellectech Co. Ltd. Representative organizations of foreign companies must trust and pay legal employment agencies to sign employment contracts with Chinese workers.
Foreign employers are also required to apply for certain employment certificates for each Chinese employee through the agencies, and the issued certificates will also be subjected to annual inspections.
Foreign employers and agencies caught violating these requirements will be issued fines ranging from 5,000 yuan up to 10,000 yuan. Workers that are caught working for foreign organizations illegally will also be fined 1,000 yuan.
