Apple Might Lose iPad Trademark Case to Proview
Apple might not be able to use the iPad trademark in the Chinese mainland as a provincial court regarded Shenzhen Proview Technology as the rightful owner of the iPad trademark. The court is now mediating a settlement between the two companies.
The deputy director of the National Copyright Administration said the government have acknowledge Shenzhen Proview to be the rightful owner of the trademark, while the dispute between Shenzhen Proview and Apple is still going through a judicial process and according to government laws Shenzhen Proview is still the rightful owner and user of the trademark.
Lawyers for Shenzhen Proview have been planning to settle the case with Apple but both companies are still in disagreement on the amount of money that is involved. The possibility of an out of court settlement is being planned with the Guangdong Higher People’s Court helping out with the arrangements. But before any settlements can happen both companies need to wait for the final ruling of the court that with decide on the ownership rights of the trademark.
Although Proview Group have sold its worldwide rights of the iPad trademark to Apple, the registration was never transferred to the mainland, in which the trademark is registered by Shenzhen Proview.
