Qianhai Court Handles First International Case
Representatives from a Dongguan company and from the US architectural design firm braved the storm’s aftermath came to Qianhai court yesterday to settle a dispute that was derived from a contract that was signed last year. This will be the first case that involves a foreign firm and heard by a Shenzhen Court of International Arbitration in Qianhai.
The Qianhai court was set up last year for this kind situation, while both sides declined to identify and comment on the dispute and the results of the hearing will not be released for a few days. The US firm is a design company that is based in New York approached the court to ask for help in settling payment for their services provided to the Dongguan firm.
The litigation was under a million yuan by judging by the fact that there is only one mediator Hong Kong lawyer Gary Soo. Both sides said that in their contract both agreed to settle at the Shenzhen Court of International Arbitration in Qianhai if ever disputes will arise, showing the court’s influence even if it was just recently set up. The contract was signed in December after the Qianhai court has updated their arbitration rules that will have them in line with international practice.
Qianhai gained the Central Government approval in exploring ways to improve the legal system and is working on creating an independent and open legal platform to settle international disputes.
